DrinkSmart Terms of Service

1. Acceptance of Terms

By accessing and using DrinkSmart (the "Service"), provided by Nuvio Digital Agency ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Description of Service

DrinkSmart is a real-time reminder app for drinking sessions that helps users maintain awareness during alcohol consumption.

What is a "Drinking Session"?

A drinking session refers to a user-initiated time period during which the user actively consumes alcohol and receives periodic reminders from the app. Users can start and end sessions at any time. Only one session can be active at a time.

3. User Eligibility

1. Age Requirement: You must be of legal drinking age in your country of residence to use this Service:
   • United States: 21+ years old
   • South Korea: 19+ years old
   • Japan: 20+ years old
   • Europe: 18+ years old (varies by country)
2. Anonymous Authentication: The app uses Firebase anonymous authentication - no email or password required.
3. Account Responsibility: You are responsible for all activities associated with your device.
4. Age Rating: The app is rated 17+ on app stores due to alcohol-related content.

4. Premium Subscription

1. Subscription Plans: Premium subscriptions are available on monthly or annual basis.
2. Pricing: Subscription fees are clearly displayed within the app.
3. Auto-Renewal: Subscriptions automatically renew unless cancelled before the renewal date.
4. Cancellation: You can cancel your subscription anytime through your app store account settings.
5. Refunds: Refunds are processed according to the policies of the respective app stores (Apple App Store or Google Play Store).
6. Price Changes: We reserve the right to modify subscription prices with advance notice.

5. User Conduct

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service or servers
• Upload or transmit viruses or malicious code
• Misrepresent your age to access the Service
• Reverse engineer or attempt to extract source code
• Use the Service in any way that violates applicable laws

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of Nuvio Digital Agency and are protected by international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices regarding your personal information.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NUVIO DIGITAL AGENCY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

The Company's total liability shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless Nuvio Digital Agency, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses, including reasonable legal fees, arising from your use of the Service, violation of these Terms, or violation of any rights of another party.

11. Termination

We reserve the right to terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to violations of these Terms, illegal activities, or at our sole discretion.

Upon termination, your right to use the Service will cease immediately.

12. Changes to Terms

We may modify these Terms at any time. We will notify users of material changes through the app or via the email you provided (if applicable). Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

It is your responsibility to review these Terms periodically.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of law provisions.

Any disputes arising from these Terms or use of the Service shall be resolved in the courts of the Republic of Korea. However, we may seek injunctive relief in any court of competent jurisdiction.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
